Topic: The State of Fair Use in Training AI Large Language Models
This June, judges Alsup and Chhabria in the Northern District of California handed down the first two decisions regarding whether various types of training for AI models constituted fair use under federal copyright law in the cases Bartz v. Anthropic PBC and Kadrey v. Meta Platforms, Inc. In the midst of those decisions, appeals, licenses, guidance from the U.S. Copyright Office, and proposed legislation have continued to shape the outlook for fair use as applied to training AI and how authors, publishers, and AI companies are navigating these issues. This CLE seminar will analyze the tensions between various approaches and explore the implications for potential clients.
