Topic: Reassessing Software Patent Law

Some combinations of physical materials are patentable. Conventional materials, like wood, textiles, metal, glass, rubber, and plastic, can be combined in ways that are sufficiently inventive to secure legal protection. When it comes to combinations of software elements, however, patent law has been more complicated—but is it complicated in appropriate ways? This CLE will begin with a brief history of patent law with respect to software inventions, leading to a review of the state of software patenting as practiced today, with an eye on special challenges related to patenting software. The discussion will conclude with a summary of how various aspects of patent policy have been applied given those special challenges, and a brief exploration of whether patent policy might be applied more appropriately to software inventions.
