Topic: So You Think You Have a Trade Secret?
Liability in a trade secret misappropriation case depends on proof of a trade secret and proof the trade secret was misappropriated. This CLE will focus on an aspect of proving a trade secret – identifying the trade secret with reasonable particularity – and recent Oregon cases on when a plaintiff must identify its trade secrets. The issue has significant strategic and tactical implications in trade secret litigation, including what stage of a litigation a trade secret can or must be identified, possible effects on the scope and timing of discovery, allocation of resources, motion practice, and case strategy. Please join us to hear an overview of current case law from practitioners who have represented both plaintiffs and defendants in trade secret misappropriation cases, as well as the in-house counsel perspective.
Speakers:
Erick J. Haynie is a partner in the Portland office of Perkins Coie. Over his 20 years of practice, Erick has tried over 40 matters to judgment in addition to numerous injunctive proceedings and dispositive motions, including trade secret misappropriation cases. In recent years, his focus has been on the trial of real estate disputes, commercial lease disputes, complex business torts and large contract disputes.
Stephanie Hines is the General Counsel at Planar Systems, a leading-edge display technology company with headquarters in Hillsboro. She has also served as corporate counsel at an energy company and a technology company. Before going in-house, Stephanie practiced commercial litigation at private law firms.
Julia E. Markley is a partner in the Portland office of Perkins Coie. She represents technology and retail companies in litigation over trade secrets, trademarks, copyrights, non-disclosure agreements, non-competition agreements, licenses, and business contracts. From 2016-2020, Julia served on Perkins Coie’s Executive Committee, the governing body of the firm.
