Speaker: Administrative Patent Judge Terrence McMillin

Please join us as speaker Terrence McMillan presents on Effective Advocacy and Strategy before the PTAB.

Judge McMillin will discuss the “do’s and don’ts” of presenting your case to the PTAB. The presentation will focus on effective advocacy by focusing on the critical issues and making sure your arguments are based on the claim language and the challenged patent.

Judge McMillin will tell you that PTAB APJs can be expected to know the record, know the law, and know the rules. He will warn you against making factual misrepresentations or trying to get the PTAB to follow “bad law.” And, he will tell you that violating the PTAB’s rules can harm your case no matter how meritorious it might otherwise be.

There will be time for you to ask questions of an experienced administrative patent judge, so you should come prepared to ask all the questions you may have regarding the PTAB.

Terry McMillin is an Administrative Patent Judge (APJ) on the Patent Trial and Appeal Board (PTAB) of the United States Patent and Trademark Office (USPTO). He has been a judge on the PTAB since June 2014. The PTAB decides appeals from adverse decisions of Examiners at the USPTO and conducts trials to determine patentability of claims in patents subsequent to issuance (post-grant reviews).

Prior to joining the PTAB, McMillin was “Of Counsel” to Klarquist Sparkman LLP in Portland, Oregon. At Klarquist, he worked primarily on litigation.

From 2000–2013, McMillin was Executive Director of the Intellectual Property Department at International Game Technology (IGT), the world’s largest manufacturer of gaming equipment such as slot machines, lottery terminals, player-tracking systems, accounting systems, and other gambling and lottery equipment and supplies.

Prior to IGT, McMillin was in private practice in Chicago mainly focused on IP litigation. During the course of his career, McMillin has represented such well-known companies as Johnson & Johnson, Procter & Gamble, Dow Corning, Sara Lee, SEGA, National Gypsum, and Crate & Barrel.
