Topic: Novel Issues in Trade Secret Litigation
In practice, trade secret litigation can involve a great deal more than just trade secret law. This CLE will survey a series of novel legal issues that sometimes arise in — and can vastly impact — disputes involving the alleged misappropriation of trade secrets. For example, can measures taken to protect trade secrets, or even the assertion of a trade secret claim itself, lead to a violation of the antitrust laws? (Potentially, yes.) Might laws regulating noncompete agreements and other kinds of restrictive covenants impose de facto limits on certain trade secret plaintiffs’ claims and remedies? (Again, yes.) Even in non-unionized workplaces, does traditional labor law have anything to say about how an employer may and may not seek to protect its trade secrets? (Once again, yes.) Should any aspects of criminal law influence how civil practitioners advise clients in matters involving trade secrets? (Sometimes, yes.) Following a brief overview of the Uniform Trade Secrets Act and the related Defend Trade Secrets Act, we’ll wrestle with those and other similar problems that should interest litigators and non-litigators alike.
Speakers: Ed Piper and Kelsie Crippen
Ed Piper is an attorney with Glenmorrie Law LLC, a boutique firm that he established in May 2025. Ed maintains a general litigation practice with emphasis on information security, privacy, and employment law. He began his career with Paul Hastings LLP in Palo Alto, California and later practiced at Stoel Rives LLP and Angeli & Calfo LLC, each in Portland, Oregon. He also served as general counsel to a large technology company that provides cloud-based business services to customers both in the United States and internationally.
Kelsie Crippen is an attorney with Markowitz Herbold PC. She has experience representing public and private clients in a broad range of complex commercial disputes, including those involving antitrust and trade secret claims. Kelsie previously served as a law clerk with both Chief Justice Martha Walters of the Oregon Supreme Court and the Solicitor General’s Office of the Oregon Department of Justice. She joined Markowitz Herbold after working at another national law firm, where she handled complex commercial litigation.
