Topic: Patent Local Rules

Many United States district courts have adopted local rules of practice establishing special procedures in patent cases. These Patent Local Rules (PLRs) provide for formal exchanges of litigants’ infringement, invalidity, and other contentions, with detailed provisions governing the contents and timing of those disclosures.

This CLE will briefly examine the history of PLRs, beginning in the early 2000s in the Northern District of California. Attendees will gain insight into the unique challenges of patent litigation that led to their adoption, and will benefit from a comparative analysis of PLRs as between select jurisdictions. The session will also address patent case management strategies in federal judicial districts—like the District of Oregon—that have not yet adopted PLRs.

Speaker: Jason Wrubleski

Jason Wrubleski is an intellectual property litigator with the Schwabe law firm in Portland, Oregon, with a practice focusing on patent and trade secret issues and disputes. He is a co-editor and regular contributor to Schwabe’s “Fresh From the Bench,” a weekly web publication reporting on precedential patent cases from the Federal Circuit Court of Appeals.
